Welcome to NearbyLove. These Terms of Service ("Terms") govern your use of the NearbyLove mobile application ("App") operated by NearbyLove ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

  • You must be at least 18 years old to use NearbyLove.
  • By creating an account, you represent and warrant that you are at least 18 years of age.
  • You must not be prohibited from using the App under applicable laws.
  • You may only maintain one active account at a time.

2. Account Creation & Authentication

  • Accounts are created through Google Sign-In or Apple Sign-In. No separate passwords are required.
  • You are responsible for maintaining the security of your device and authentication credentials.
  • You must provide accurate and truthful information in your profile.
  • You may not impersonate another person or create a misleading profile.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Harass, threaten, intimidate, stalk, or abuse any other user.
  • Send unsolicited, inappropriate, offensive, or sexually explicit content.
  • Misrepresent your identity, age, or affiliation.
  • Use the App to solicit money, goods, or services from other users.
  • Engage in any commercial activity through the App without our written consent.
  • Attempt to circumvent any security or privacy features of the App.
  • Use automated systems, bots, or scripts to interact with the App.
  • Collect or harvest personal information of other users.
  • Upload content that infringes on intellectual property rights.
  • Post spam, chain letters, or pyramid schemes.
  • Interfere with the proper functioning of the App.

4. Content Guidelines

4.1 Photos

  • All photos must be of you and must accurately represent your current appearance.
  • Nudity, sexually explicit content, and graphic violence are prohibited.
  • Photos containing minors are prohibited.
  • Photos promoting illegal activities are prohibited.
  • We reserve the right to remove any photos that violate these guidelines.

4.2 Messages & Voice Content

  • All messages, voice recordings, and voice intros must comply with these Terms.
  • Threatening, harassing, or abusive content is prohibited.
  • Sharing of private information about other users without their consent is prohibited.
  • Voice recordings should accurately represent you and not be manipulated to deceive.

4.3 Profile Information

  • Your bio and profile details must be truthful and not misleading.
  • Promotional content, advertisements, or solicitations are not permitted in profiles.
  • Contact information (phone numbers, social media handles, websites) in bios is discouraged.

5. Safety Features & Disclaimers

5.1 Safe Date (Guardian Angel)

  • Safe Date is a safety tool designed to help users feel more secure during in-person meetings.
  • Safe Date is not a substitute for personal safety measures or emergency services.
  • In an emergency, always contact local emergency services (e.g., 911) first.
  • We do not guarantee the reliability, accuracy, or availability of the Safe Date feature at all times.
  • Guardian functionality depends on network connectivity and GPS accuracy.
  • We are not responsible for any harm that occurs during or after in-person meetings.

5.2 Location Services

  • Location-based features require GPS permissions on your device.
  • We apply privacy offsets to protect your exact location, but no system is perfect.
  • We recommend exercising caution when meeting people in person.

5.3 User Interactions

  • We do not conduct criminal background checks on users.
  • We do not verify the identity or background of users beyond authentication provider information.
  • You are solely responsible for your interactions with other users.
  • Always meet in public places for initial meetings.
  • Use the Safe Date feature when meeting someone for the first time.

6. Intellectual Property

  • The NearbyLove name, logo, design, and all related intellectual property are owned by us.
  • You may not copy, modify, distribute, or create derivative works of the App.
  • By uploading content (photos, voice recordings, messages), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the App for the purpose of providing our services.
  • You retain ownership of your content and may delete it at any time.

7. Blocking & Reporting

  • You can block any user at any time. Blocked users cannot contact you or view your profile.
  • You can report users who violate these Terms. We review all reports and take appropriate action.
  • False or malicious reports may result in suspension of your account.
  • We may take action against reported users including warnings, temporary suspensions, or permanent bans.

8. Account Termination

  • You may delete your account at any time through the App settings.
  • Upon deletion, all your data including photos, messages, matches, and profile information will be permanently removed within 30 days.
  • We may suspend or terminate your account if you violate these Terms.
  • We may terminate the App or any features at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind.
  • We do not warrant that the App will be uninterrupted, error-free, or secure.
  • We are not liable for any damages arising from your use of the App.
  • We are not responsible for the conduct of any user, whether online or offline.
  • We are not liable for any content posted by users.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless NearbyLove, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

  • Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration.
  • You agree to resolve disputes individually, without class actions or class arbitration.
  • These Terms are governed by and construed in accordance with applicable law.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App and delete your account.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
