Terms of Service

Welcome to NearbyLove. These Terms of Service ("Terms") govern your use of the NearbyLove mobile application ("App") operated by NearbyLove ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, please do not use the App. The App includes its web version at app.nearbylove.app, and these Terms apply to it in the same way.

1. Eligibility

  • You must be at least 18 years old to use NearbyLove.
  • By creating an account, you represent and warrant that you are at least 18 years of age.
  • You must not be prohibited from using the App under applicable laws.
  • You may only maintain one active account at a time.
  • NearbyLove is offered only in the countries where it is open. When you create an account you state the country you live in, and you confirm that it is one of those countries. We may refuse or close an account created from another country, including through a VPN or a false statement.

2. Account Creation & Authentication

  • Accounts are created through Google Sign-In. There is no email and password route and no other way to sign in, so nobody creates an account here anonymously. There is no separate password for you to set or remember.
  • You are responsible for maintaining the security of your device and authentication credentials.
  • You must provide accurate and truthful information in your profile.
  • You may not impersonate another person or create a misleading profile.
  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • Service notifications about your account and activity are part of using the App: messages, requests and matches, Spark, Safe Date and safety alerts, calls, account and security notices, a weekly reminder before radar night, and at most one reminder a day about something waiting for your answer. Under "Notifications I want" in Settings you can switch off messages, requests and matches, Spark, reminders and radar night; safety alerts, calls and account notices stay on. Marketing messages are sent only if you agree to them, and you can stop them at any time in Settings. The "somebody is waiting to laugh" push from Laugh First, Look Later can be switched off there too.

3. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Harass, threaten, intimidate, stalk, or abuse any other user.
  • Send unsolicited, inappropriate, offensive, or sexually explicit content.
  • Misrepresent your identity, age, or affiliation.
  • Use the App to solicit money, goods, or services from other users.
  • Engage in any commercial activity through the App without our written consent.
  • Attempt to circumvent any security or privacy features of the App.
  • Use automated systems, bots, or scripts to interact with the App.
  • Collect or harvest personal information of other users.
  • Upload content that infringes on intellectual property rights.
  • Post spam, chain letters, or pyramid schemes.
  • Interfere with the proper functioning of the App.

4. Content Guidelines

4.1 Photos

  • All photos must be of you and must accurately represent your current appearance.
  • Nudity, sexually explicit content, and graphic violence are prohibited.
  • Photos containing minors are prohibited.
  • Photos promoting illegal activities are prohibited.
  • We reserve the right to remove any photos that violate these guidelines.

4.2 Messages & Voice Content

  • All messages, voice recordings, and voice intros must comply with these Terms.
  • Threatening, harassing, or abusive content is prohibited.
  • Sharing of private information about other users without their consent is prohibited.
  • Voice recordings should accurately represent you and not be manipulated to deceive.

4.3 Profile Information

  • Your bio and profile details must be truthful and not misleading.
  • Promotional content, advertisements, or solicitations are not permitted in profiles.
  • Contact information (phone numbers, social media handles, websites) in bios is discouraged.

5. Safety Features & Disclaimers

5.1 Safe Date (Guardian Angel)

  • Safe Date is a safety tool designed to help users feel more secure during in-person meetings.
  • Safe Date is not a substitute for personal safety measures or emergency services.
  • In an emergency, always contact your local emergency services first (for example 911, 100 or 112, depending on where you are).
  • We do not guarantee the reliability, accuracy, or availability of the Safe Date feature at all times.
  • Guardian functionality depends on network connectivity and GPS accuracy.
  • A person invited to be a guardian can join only for that. Such an account has no dating profile and does not appear anywhere in dating, and it can create a dating profile later.
  • We are not responsible for any harm that occurs during or after in-person meetings.

5.2 Location Services

  • Location-based features require GPS permissions on your device.
  • For radar and discovery your exact position never leaves your phone. Before anything is sent it is snapped to a privacy grid, so other people see you at a nearby point rather than where you actually are. The same place always produces the same point, so repeated readings cannot be averaged back to your real position. The grid is about 250m across by default, or about 100m if you choose to be easier to find. Two features are exceptions: Spark Mode, which sends a real position so a short distance can be measured at that moment and does not store it, and Safe Date, which sends your real position to the guardian you chose. Both are described in the Privacy Policy.
  • We recommend exercising caution when meeting people in person.
  • By using the radar with background search enabled, you consent to periodic background location collection as described in our Privacy Policy. This feature is optional and can be disabled at any time.
  • By enabling Spark Mode, you consent to the momentary use of your precise location for proximity calculation and to other compatible users being notified when you pass near each other, as described in our Privacy Policy. This feature is optional, off by default, and can be disabled at any time.

5.3 User Interactions

  • You understand and accept that meeting people you do not know carries risk, both online and in person, and that you take that risk on yourself. We do not introduce, vouch for, endorse or supervise any user, and we are not a party to anything that happens between you and another person. Deciding who to meet, and where and when, is yours alone.
  • We do not run criminal background checks, sex offender register checks, or any other background screening on any user. No user of NearbyLove has been screened in this way.
  • We do not verify anyone's identity, age, photographs, relationship status or intentions beyond the information Google gives us when the account is created. Photo verification is not available in the App, so no profile carries a verified badge, and the absence of a badge tells you nothing about anyone.
  • You are solely responsible for your interactions with other users.
  • NearbyLove is not responsible for the conduct of any user, in the App or when you meet, including any harm, fraud or loss caused by another user. Meeting someone in person is at your own risk; please follow our safety tips.
  • Always meet in public places for initial meetings.
  • Use the Safe Date feature when meeting someone for the first time.

6. Intellectual Property

  • The NearbyLove name, logo, design, and all related intellectual property are owned by us.
  • You may not copy, modify, distribute, or create derivative works of the App.
  • By uploading content (photos, voice recordings, messages), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the App for the purpose of providing our services.
  • You retain ownership of your content and may delete it at any time.

7. Blocking & Reporting

  • You can block any user at any time. Blocked users cannot contact you or view your profile.
  • You can report users who violate these Terms. We review all reports and take appropriate action.
  • False or malicious reports may result in suspension of your account.
  • We may take action against reported users including warnings, temporary suspensions, or permanent bans.

8. Account Termination

  • You may delete your account at any time through the App settings.
  • When you delete your account it is deleted straight away, not after a waiting period. Your profile, photos, voice recordings, messages, matches and stored locations go with it and none of it can be recovered. A small number of safety and legal records are kept afterwards. Messages you sent to our support address are also kept: the link to your account is removed, but the name, email address and text you wrote stay in them. The Delete Your Account page lists exactly what is kept and why.
  • We may suspend or terminate your account if you violate these Terms.
  • We may terminate the App or any features at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind.
  • We do not warrant that the App will be uninterrupted, error-free, or secure.
  • We are not liable for indirect, incidental, special or consequential loss, or for loss of data, profit or opportunity, arising from your use of the App.
  • We are not responsible for the conduct of any user, whether online or offline.
  • We are not liable for any content posted by users.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the law that applies to you. If the country you live in gives you consumer guarantees or other rights that cannot be contracted out of, those rights apply in full and nothing in this section reduces them. Where a limitation set out above is not permitted where you live, that limitation does not apply to you, and the rest of this section still does.

10. Indemnification

You agree to indemnify and hold harmless NearbyLove, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

  • If you have a problem, please write to us first at the address in section 14 and tell us what happened and what you would like us to do. Most things can be settled that way, and we will make a genuine effort to settle yours. Please give us a fair chance to reply before taking any other step.
  • If we cannot settle it that way, the dispute goes to the ordinary courts. A dispute heard in Israel will be decided by the competent court in Tel Aviv-Jaffa. This does not take away your right as a consumer to bring a claim, including a small claim, in the court the law allows you to turn to. If you live outside Israel, you may also bring a claim in the courts of the country where you live, and we will bring any claim against you in those courts. Nothing in these Terms takes away any right you have to complain to a consumer authority or a regulator in your own country.
  • These Terms are governed by the law of Israel, where NearbyLove is operated from. If the country you live in gives you consumer protections that cannot be set aside by agreement, those protections still apply to you and this section does not affect them.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App and delete your account.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
